It is previously stated that these conditions govern the sales by Atelier Kencre of the artworks and other products available on the website www.cartekencre.com. These conditions apply to the exclusion of any other conditions.
ARTICLE 1 – THE CUSTOMER
The Customer declares to be a natural person, aged at least 18 years old, and to have legal capacity or to hold parental authorization allowing them to place an order on the Site. When registering the Customer's personal data, the latter must ensure the accuracy and completeness of the mandatory data provided. In case of an error in the labeling of the recipient's coordinates, the company Atelier Kencre cannot be held responsible for the inability to deliver the product. The company Atelier Kencre reserves the right to cancel any order when the customer's IP address is domiciled in a country different from the billing and/or delivery address. The subscription to a contract governed by these general conditions with Atelier Kencre implies acceptance, by the internet user, of all the general conditions, who thereby acknowledges having fully acquainted themselves with them. This acceptance shall consist of the internet user checking the box corresponding to the following sentence: "I have read and accept the general conditions." This act of checking the box shall be deemed to have the same value as a handwritten signature by the internet user. The internet user acknowledges the evidentiary value of the automatic recording systems of the publisher of this site and, except for him/her to provide evidence to the contrary, he/she waives the right to challenge them in case of dispute. The acceptance of these general conditions implies, on the part of internet users, that they have the necessary legal capacity for this, or failing that, the authorization of a guardian or curator if they are incapable, or of their legal representative if they are minors.
ARTICLE 2 – PLACING AN ORDER
Ordering on the site is subject to compliance with the procedure put in place by Atelier Kencre, materialized by a succession of different steps that the customer must follow to validate their order. The customer will have the possibility, before definitively validating their order, to check the details thereof and its total price, and to correct any errors, before confirming it to express their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the stipulations herein. An order confirmation email summarizing the order (products, prices, quantity, etc.) will be sent to the customer by Atelier Kencre. For this purpose, the customer formally accepts the use of electronic mail for confirmation by Atelier Kencre of the content of their order.
ARTICLE 3 – PRICES
The prices of our products are indicated in euros, all taxes included, excluding participation in processing and shipping costs. These prices are communicated in Euros. In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or any other local taxes or import duties or state taxes may be payable for any order shipped outside the European Union. These duties and charges are not the responsibility of Atelier Kencre. They will be at your expense and are your sole responsibility in terms of declarations and payments to the competent authorities and/or organizations in your country. We advise you to inquire about these aspects from your local authorities. All orders, regardless of their origin, are payable in Euros. Atelier Kencre reserves the right to change its prices at any time, but the products will be invoiced based on the rates in effect at the time of the order registration, subject to their availability.
ARTICLE 4 – VALIDATION
When you click on the "Validate my order" button after the order process, you declare that you accept it as well as all these General Terms and Conditions of Sale in full and without reservation. The data recorded by www.cartekencre constitutes proof of all transactions between Atelier Kencre and its customers. The data recorded by the Paypal payment system and/or the payment service provided by PrestaShop Checkout constitutes proof of financial transactions.
ARTICLE 5 – AVAILABILITY
Our product offers are valid within the limits of available stocks. When a product is no longer available, it will be displayed as SOLD OUT or OUT OF STOCK.
ARTICLE 6 – PAYMENT & SECURITY
Payment for your purchases is made through the secure payment service provided by PrestaShop Checkout or by Paypal. These two payment methods are subject to a security system. All payment details are the responsibility of the secure Paypal and PrestaShop Checkout service.

The products offered comply with French legislation in force. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you intend to order. The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, Atelier Kencre's liability cannot be engaged in the event of an error in one of these photographs or texts. Atelier Kencre shall not be held responsible for the non-performance of the contract in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike particularly of postal services and means of transport and/or communications, flood, fire. Atelier Kencre shall not incur any liability for any indirect damages arising from these, loss of business, loss of profit, damages or costs. Atelier Kencre disclaims all liability in the event that the content of these sites violates the applicable legal and regulatory provisions. This contract is subject to French law. The language of this contract is French. In case of dispute, French courts shall have exclusive jurisdiction.
